A person’s right to leave their estate to whoever they choose is limited in Victoria by legislation (Administration and Probate Act 1958). The Act has been amended from time to time and the latest provisions mean that, if a person is “eligible”, they may apply to a Court for “further and better provision” to be made from the estate than was provided for them in the deceased’s Will.
